Terms of Service

These Terms govern access to and use of the Viewy platform (“Platform”), including the free Home Seeker service, the paid Pro service, and the AI assistant known as “Corey”.

By using the Platform you agree to these Terms.

If you do not agree, you must not use the Platform.

1. Nature of the Platform

Viewy is a passive informational technology platform that displays property-related data. Viewy does not:

Act as a real estate agent or buyer’s agent
Broker or facilitate transactions
Verify ownership or identity
Arrange communication between people
Introduce buyers and sellers
Negotiate or assist negotiations
provide professional advice
Viewy is not a marketplace, intermediary, or lead generation service.
No relationship of agency, partnership, employment, fiduciary duty or advisory duty is created between Viewy and any user.

2. Informational Service Only

All content on the Platform is general information only. Nothing on the Platform constitutes:

Financial advice
Property advice
Valuation advice
Legal advice
Investment advice
You must obtain independent professional advice before acting on any information.

3. Data Accuracy — Assumption of Risk

Data is obtained from third-party providers, public records and automated processing systems.
Viewy does not guarantee accuracy.
Data may be inaccurate, incomplete, outdated, duplicated, misattributed or incorrect.
Property estimates are opinions, not valuations.
You acknowledge the data may be wrong and you accept all risk arising from reliance on it.
You must independently verify all information before making decisions.
The Platform may intentionally display limited information and the absence of a field does not indicate an error in the underlying records.

4. AI Assistant (Corey)

Corey is an automated machine-generated text tool.
Corey may produce incorrect, misleading or nonsensical output.
Corey does not provide advice or recommendations.
You agree not to rely on Corey when making financial or property decisions.

5. Communications and Contact Information

Viewy never contacts property owners on behalf of users.
Viewy does not send emails, SMS, calls, messages or notifications to any person for any user.
Viewy does not enable, route, schedule or facilitate communication between people.
The Platform only displays information.
Any decision to contact a person is made independently by the user using their own devices and systems outside the Platform.
Viewy is not a telemarketing service, messaging service, introducer service or lead generation service.
The recipient of any communication is not a customer of Viewy.

6. User Responsibility for Contact

If a user contacts any person after viewing data on the Platform:

The communication is created entirely outside the Platform
The user acts independently
The user is not acting on behalf of Viewy
The user alone is legally responsible for the communication.

The user must comply with all applicable laws including:

Privacy Act 1988 (Cth)
Spam Act 2003 (Cth)
Do Not Call Register Act 2006 (Cth)
Australian Consumer Law
All State and Territory legislation relating to property and solicitation

7. Indemnity

You indemnify and hold harmless Viewy and its officers, employees and contractors against any claim, complaint, investigation, fine, penalty, liability, loss or legal cost arising from:

Contacting any person
Telemarketing activity
Harassment or nuisance allegations
Privacy complaints
Misuse of personal information
Reliance on data
Reliance on AI output
Breach of law
Misuse of the Platform

This indemnity continues after your use of the Platform ends.

8. Acceptable Use

You must not:

Scrape or harvest data
Build external databases
Resell or redistribute information
Automate outreach or messaging
Bulk contact individuals
Misrepresent identity
Pressure or harass individuals
Viewy may suspend or terminate access for suspected misuse.

9. Third-Party Data Sources

All data originates from third-party sources. Viewy is not responsible for errors in:

Government records
Agency feeds
Public registries
Mapping systems
External datasets

10. Service Availability

The Platform may be modified, interrupted or discontinued at any time.

Viewy has no obligation to maintain availability or features.

11. Limitation of Liability

To the maximum extent permitted by law, Viewy excludes all liability arising from use of the Platform.

Where liability cannot legally be excluded, Viewy’s total aggregate liability is limited to the lesser of:

(a) fees paid by you in the previous 12 months; or
(b) AUD $50.

Viewy is not liable for:

Financial loss
Property decisions
Missed opportunities
Reliance on data
AI output errors
Emotional distress
Reputational damage
Nothing excludes rights that cannot be excluded under the Australian Consumer Law.
