Terms of Service

General

Viewy Real Estate website (“Websites”), mobile application (“App”), and related services (together with the Websites, the “Service”) are operated by MissionFox Pty Ltd, ACN 76 601 184 963 (“Viewy Real Estate,” “us,” or “we”).

Access and use of the Service are subject to these Terms and Conditions of Service (“Terms and Conditions”). By accessing or using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions, including any future modifications.

Viewy Real Estate may amend, update, or change these Terms and Conditions. If we do this, we will post a notice of changes on the Website and App for at least 7 days and indicate the “last revised” date at the bottom of this document. Any revisions will take effect on the earlier of:
(i) the end of such 7-day period; or
(ii) the first time you access or use the Service after such changes.

If you do not agree to abide by these Terms and Conditions, you are not authorized to use, access, or participate in the Service.

 

Subscriptions and Access

The Service includes both free and paid subscription tiers:

  • Home Seeker: Provides access to suburb metrics, property insights, reports, and saved property functionality.

  • Professional: Provides additional access to owner contact details, extended datasets, and tools for real estate professionals.

By subscribing, you agree to the applicable subscription fees and billing terms provided at the point of purchase. Subscription fees are non-refundable except where required by law.

 

Real Estate Reports

Viewy Real Estate offers real estate reports for a fee, including suburb and insights reports.

All reports, data, and insights are supplied strictly on an “as is” and “as available” basis. While we endeavour to source reliable and current information, we make no representation or warranty of any kind, express or implied, regarding the accuracy, completeness, currency, or reliability of the information. Reports are provided for general informational purposes only and must not be relied upon as professional advice.

We strongly encourage users to seek independent professional advice before making any property-related decisions.

 

AI Assistant and Voice Services (“Corey”)

The Service includes “Corey,” an AI-driven conversational assistant available by text and/or voice. Corey may:

  • Answer property and suburb questions.

  • Provide market insights, ownership information, and property comparisons.

  • Suggest mortgage options and, where relevant, refer you to a Viewy-approved mortgage broker.

  • Suggest professional services (e.g., real estate agents, off-market specialists).

 

Data Collection

When using Corey or other voice/text features, we may collect voice recordings, transcriptions, and text queries. This data is processed solely to deliver responses, generate insights, or facilitate partner referrals. Data is retained only for as long as necessary unless required by law.

 

Disclaimer

Corey is an automated, machine-learning-based system. Outputs generated by Corey (whether text, voice, or otherwise) may be inaccurate, incomplete, misleading, or inconsistent with professional advice. Corey does not, and cannot, provide legal, financial, tax, or professional real estate advice. You acknowledge and agree that Corey is provided solely for general informational purposes, and you must obtain your own independent professional advice before making property, financial, or legal decisions. To the maximum extent permitted by law, Viewy Real Estate disclaims all liability for reliance on Corey’s outputs.

 

Ownership Data and Privacy

Certain subscription tiers may provide access to ownership details sourced from third-party databases and public records. You acknowledge and agree that:

  • Ownership data is provided strictly for legitimate property research and professional real estate purposes only.

  • You must not use ownership details for unlawful purposes, including but not limited to spam, harassment, discrimination, or direct marketing without the consent of the individual concerned.

  • Viewy Real Estate makes no warranty regarding the accuracy, completeness, or currency of ownership data, and you assume all risk associated with your reliance on such information.

  • You are solely responsible for ensuring your use of ownership data complies with applicable laws, including but not limited to the Privacy Act 1988 (Cth), the Spam Act 2003 (Cth), and any professional regulations that apply to your industry.

  • Viewy Real Estate disclaims any and all liability arising from your use, misuse, or disclosure of ownership data.

 

Partner Referrals

The Service may introduce you to, or provide referrals for, mortgage brokers, real estate agents, suburb sponsors, or other third-party service providers (“Partners”). These introductions are provided for convenience only.

Viewy Real Estate does not endorse, recommend, or warrant any Partner, and no partnership, joint venture, employment, or agency relationship exists between Viewy Real Estate and any Partner. All dealings you have with Partners are solely between you and the Partner, and you accept that Viewy Real Estate has no liability, responsibility, or obligation for the acts, omissions, representations, or services of Partners.

 

Description of Service

The Service provides access to publicly available and licensed property data, including:

  • Property address, bedrooms, bathrooms, car spaces, size, amenities, and last sale details.

  • Suburb-level performance metrics (median prices, yields, growth trends).

  • Ownership data (where legally available and accessible under your subscription).

  • Saved property and comparison tools to support property search.

Viewy Real Estate may, in its sole discretion, update, suspend, improve, or discontinue any aspect of the Service at any time.

 

User-Generated Content

The Service may allow you to save properties, add notes, submit information, or otherwise contribute content (“User Content”). You are solely responsible for any User Content you create or submit. Viewy Real Estate does not monitor, verify, or endorse User Content and disclaims any liability for it.

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free licence to use, display, and store it solely for the purpose of providing the Service.

 

Cross-Border Data Transfers

Your personal information may be transferred and stored across jurisdictions including Australia and Singapore. We ensure that all such transfers comply with relevant data protection laws and that your information is handled securely.

 

Platform Usage and Restrictions

In accessing or using the Service, you agree that you will not:

(a) use any automated device, software, process, or means to access, retrieve, scrape, or index the Service or any content on our Websites;
(b) use any device, software, process, or means to interfere or attempt to interfere with the proper working of our Websites;
(c) undertake any action that imposes an unreasonable or disproportionate load on our infrastructure;
(d) use or index any content or data on our Service for purposes of:
(i) constructing or populating a searchable database of properties;
(ii) building a database of property information; or
(iii) constructing or populating a property data or property insights product;
(e) transmit spam, chain letters, contests, junk email, surveys, or other mass messaging;
(f) use the Service or any content in any manner which is, in our sole discretion, not reasonable or not for the purpose for which it is made available;
(g) violate the rights of any person, including copyright, trade secret, privacy, or other intellectual property rights;
(h) pose as any person or entity or attempt to solicit money, passwords, or personal information;
(i) act in violation of these Terms or any applicable law;
(j) reproduce, republish, retransmit, modify, adapt, distribute, translate, create derivative works or adaptations of, publicly display, sell, trade, or exploit the Service or any content except as expressly authorized; or
(k) transmit or attempt to transmit any viruses, worms, defects, Trojan horses, or other harmful items.

 

Third-Party Links and Content

The Service may contain third-party content and links. These third-party content providers are solely responsible for the accuracy, reliability, and legality of their content. Viewy Real Estate does not endorse or assume any responsibility for third-party content, and you should make your own inquiries before relying on it.

 

Indemnification

You agree to defend, indemnify, and hold harmless Viewy Real Estate and its directors, officers, employees, contractors, agents, suppliers, licensors, successors, and assigns, from and against all claims, damages, obligations, losses, liabilities, and expenses (including legal fees) arising out of your access or use of the Service, your breach of these Terms, or any User Content or third-party content you provide.

 

Limitation of Liability

To the fullest extent permitted by law:

  • Viewy Real Estate, its directors, officers, employees, contractors, and affiliates will not be liable for any indirect, consequential, incidental, exemplary, or punitive loss, damage, cost, or expense, including without limitation loss of profit, revenue, goodwill, opportunity, capital, data, or anticipated savings, whether arising in contract, tort (including negligence), equity, statute, or otherwise.

  • Viewy Real Estate’s aggregate liability to you for any claim, damage, loss, or expense arising in connection with the Service will not exceed one hundred Australian dollars (AUD $100).

  • You acknowledge and agree that you are solely responsible for any property, financial, or legal decisions you make, and you release Viewy Real Estate from any and all liability in connection with such decisions.

 

Australian Consumer Law Carve-Out

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (ACL) or any other applicable legislation that cannot be excluded by agreement.

Where our liability under the ACL cannot be excluded but can be limited, it is limited, at our option, to:
(a) resupplying the relevant services; or
(b) paying the cost of having the services resupplied.

 

Jurisdiction

These Terms and Conditions, and all matters relating to your use of the Service, are governed by the laws of Victoria, Australia. By using the Service, you irrevocably submit to the jurisdiction of the courts of Victoria, Australia.
